By accessing or using the Infusive application (“Infusive,” “the App,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the App.

By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from Infusive Inc. This includes SMS messages for conversations (between employees), conversations (external). Message frequency varies. Message and data rates may apply.

2. Description of Service

3. Eligibility

You must be at least 18 years old to use Infusive. If you are accessing Infusive on behalf of a clinic, medical practice, or organization, you represent that you have the authority to bind that entity to these Terms.

4. User Accounts

  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity that occurs under your account.
  • You agree to notify Infusive immediately of any unauthorized access or security breach.

Infusive reserves the right to suspend or terminate accounts that violate these Terms or threaten platform security.

5. Clinical Use & Compliance Responsibilities

Infusive does not provide medical advice, diagnosis, or treatment. The platform offers tools and support materials, but clinical decisions remain solely with licensed medical professionals.

Users agree to:

  • Comply with all applicable federal and state laws, including HIPAA, OSHA, state pharmacy regulations, and board-specific rules.
  • Validate the accuracy of any clinical, regulatory, or compliance-related information before applying it.
  • Use Infusive as a supportive tool rather than a replacement for professional judgment.

6. Privacy & Data Protection

Your use of Infusive is also governed by our Privacy Policy. By using the App, you consent to the collection, storage, and processing of information as described in the Privacy Policy.

If you upload, store, or process patient-related information, you represent that:

  • You are authorized to do so under applicable laws.
  • You will maintain required safeguards for protected health information (PHI).
  • You will not misuse or improperly disclose such information.

7. Subscription, Billing, and Payments

Access to certain features may require a paid subscription. By subscribing, you agree to:

  • Provide accurate billing information.
  • Authorize Infusive to charge your payment method.
  • Understand that fees are non-refundable unless expressly stated otherwise.

Infusive may adjust pricing at any time, with reasonable notice to subscribers.

8. Acceptable Use

You agree not to:

  • Use Infusive for any unlawful, harmful, or fraudulent activity.
  • Reverse engineer, modify, or create derivative works from the App.
  • Attempt to gain unauthorized access to systems, servers, or data.

12. Limitation of Liability

  • Loss of data, revenue, profits, or business
  • Errors, downtime, or service interruptions
  • Issues arising from third-party services

Infusive’s total liability for any claim will not exceed the amount paid by you in the 12 months preceding the claim.

You agree to indemnify and hold harmless Infusive, its owners, employees, and partners from any claims, damages, liabilities, or expenses arising out of:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any laws, regulations, or third-party rights

14. Termination

Infusive may terminate or suspend your account at any time for conduct that:

  • Harms the platform or other users

Upon termination, your right to use the App ceases immediately.

These Terms are governed by the laws of the state of North Carolina without regard to conflict-of-law principles.
